Field recovery agents or doorstep collection agents have very limited powers and are very strictly regulated in terms of what they must do and what they cannot do under any circumstances. It is important for you to understand what your rights are when you have someone knocking on your door or calling you at an unsociable hour and in any event, no one has any right to make you feel intimidated or demeaned in your own home.

Knowing your rights is one of the first steps to getting out of your financial difficulties and getting a good night’s sleep!

Debt collectors have very little power – in fact about all they can do is to knock on your door or call your telephone number and ask for you to speak to them. Many people question what their purpose is in fact if they can do so little? In essence they are establishing that you live at the address given and are a tangible reminder that you owe money and need to come to terms to arrange repayment – for many people it is a source of deep seated shame that they owe money and this frequently is played on to get people to pay their debts.

Doorstep collection agents have no power to enter your home or to take your possessions or repossess your car – they can do nothing without a court order and in many instances, only a bailiff can exercise powers to repossess property or enter your home. Collection agents are governed by a very strict code of conduct and must adhere to it at all times. If you believe a collection agent is behaving inappropriately or unprofessionally, you can complain to the Financial Ombudsman which regulates their activities as well as their employer.

The law states that any person who unduly coerces a debtor to repay monies under a contract or harasses them is committing a criminal offence. In short, there are very real teeth to the protections afforded you by law so take the time to seek professional help and advice as to what your rights are and how best to deal with your finances.

The best way of dealing with collection agents is to tackle the root of your money problems. This means facing up to your responsibilities and not ignoring the letters and demands – if you can take the initial step of seeking independent and professional advice you are on the road to being free of debt calls and the negative life influences which being in debt brings. The sooner you seek advice the far easier the solution will be and the sooner you will be free of your debt burden.

Independent and professional advice will also provide you with a thorough understanding of your rights, which are extensive, and the obligations which are placed upon you and your creditors. You need not lose sleep over bailiffs breaking into your home or doorstep collections officers seeking to gain entry when you are unsure as to what they can and cannot do and nobody can arrest you or take you to jail for non payment of commercial credit, so just remember – seek advice as soon as you realise you have an issue.
